  Directions:

Content: The goal of the project is to explore a contemporary topic in Employment Law and Ethics.  Suggestions are provided below but you are encouraged to discover your own topic, i.e., one that engages you at a personal level.

Alternative formats include – a narrated PowerPoint, podcast, video, mini-case study, original song, and experiential exercise.  In summary, you are encouraged to be creative.

Whatever the chosen format, you must demonstrate a credible research effort by providing a list of resources, i.e., references and/or bibliography.

All projects must include a legal component and an ethical component.

All projects must demonstrate originality, creativity, relevance, and deep understanding.

Essay Type Project Guidelines

  • Your entry should be 1500 to 2000 words.
  • Grammar, clarity, brevity – they all matter.
  • Citations should be provided as appropriate. Typically 5-10 references are sufficient. (Chicago Style)
  • Concrete examples are important, especially if the concept under discussion is complex or abstract. Original examples are particularly welcomed.

Student Inquiry

While I have not fully vetted this idea with the group, I feel strongly about gender bias in performance reviews (https://hbr.org/2017/04/how-gender-bias-corrupts-performance-reviews-and-what-to-do-about-it). Based on my reading, Price Waterhouse vs Hopkins found discrimination on failure to conform to gender stereotypes as covered under Title VII, but practically speaking, we know this remains widespread in organizations. It is also very difficult to prove as you rarely have access to someone else’s performance review. For my audience, I would want organizational leaders and managers to first acknowledge this and secondly, take steps to address this more formally. One example I found with evidence for reducing bias was changing rating scales ( https://hbr.org/2019/04/one-way-to-reduce-gender-bias-in-performance-reviews). Is something like this too heavy on the HR management vs employment law domain?

This is a good start – but now we need to begin the process of narrowing things down.

Some hints:

Example:
Suppose pregnancy discrimination were the topic.

I would notice that this article is very “light” but in the footnote there is a law school article referenced https://scholarlycommons.law.hofstra.edu/faculty_scholarship/101
The law school article is much more rigorous and intellectually challenging. It raises a “really tough” issue.  One that needs to be understood if you want to call yourself a subject matter expert.
More specifically: What is the Capacity Based Model and how would it apply to the concerns of my audience.

Audience example:  There is currently a big effort to recruit women to long haul truck driving jobs. If your audience was the American Trucking Association you might ask  “What would they need to know about the Capacity Based Model?   How would knowing about the strengths/ limitations of the Capacity Based Model help them accommodate the legal and ethical rights of pregnant drivers?
Alternatively: Imagine a different audience (e.g. nurses in a hospital setting). What would that audience need/want to know about the Capacity Based Model?
