legal environment of business

Initial posts are to be complete thoughts based on logic gleaned from the text or some other economic source.  Sources are to be cited; therefore, students need at least one good source in addition to their textbook for the initial post each week.  Students must offer a thoughtful initial post; therefore, the initial post must be between 250-500 words.

Many cases involve difficult decisions for juries and judges. Often both parties have legitimate, opposing arguments. Most chapters in this book will have feature called, “You be the Judge,” in which we present the facts of the case but not the court’s holding.

We offer two opposing arguments based on the kinds of claims the lawyers made in court. You are responsible for debating and deciding which position is stronger by adding in your own argument with supporting information from your textbook and one outside source cited in APA citation.

The following case is another negligence lawsuit, with issues that overlap those of the Pub Zone Case (page 17-18 of Chapter 1 in your textbook or the end of Chapter 1 in your E-Book). You be the Judge is 1-5C and the Case is under that “Del Lago Partners, Inc. v. Smith”.  This time the court confronts a fight that resulted in a death. The victim’s distraught family sued the owner of a bar, claiming that one of his employees was partly responsible for the death. once again, the defendant asked the court to dismiss the case, claiming that he owed no duty to protect the victim-the same argument made by the Pub Zone.

But there is a difference here- this time the defendant owned the bar across the street, not the one where the fight took place. Could he be held legally responsible for the death?
